1. About these Terms These Terms and Conditions apply to the TerraMatrix website and to services, bookings, events and experiences supplied by TerraMatrix, operated by Anna Blomberg in Western Australia. By using this website, submitting a booking, purchasing a service or registering for an experience, you agree to these Terms and any additional information or conditions clearly presented to you before payment. References to “TerraMatrix”, “we”, “us” and “our” mean TerraMatrix and Anna Blomberg. References to “you” and “participant” mean the person making the booking and, where relevant, each person attending the experience.

2. TerraMatrix services TerraMatrix may offer services including: individual and shared bodywork lomilomi-inspired and womb-centred bodywork cacao ceremonies and facilitated ceremonial experiences women’s, teen and mother–daughter experiences workshops, circles and community gatherings private group experiences retreats educational and restorative wellbeing experiences. The precise inclusions, duration, price, location and eligibility requirements for each service will be described on the relevant booking or information page. Unless expressly confirmed in writing, TerraMatrix website offerings are private-pay services and are not represented as NDIS-funded supports.

3. Scope of practice TerraMatrix provides bodywork, wellbeing, educational and facilitated experiences. These services do not provide medical diagnosis, medical treatment, psychological treatment, crisis support or allied-health care. They are not a substitute for advice, assessment or treatment from an appropriately qualified healthcare professional. No particular physical, emotional, spiritual or therapeutic outcome is promised or guaranteed. Individual experiences and responses vary. TerraMatrix may recommend that you seek medical or other professional advice before participating where a service appears unsuitable, unsafe or outside TerraMatrix’s professional scope.

4. Bookings and acceptance A booking is not confirmed until: the required booking information has been provided any required deposit or payment has been received you have received written or electronic booking confirmation. You are responsible for checking that the service, date, time, location, participant names and contact details shown in your confirmation are correct. TerraMatrix may decline or postpone a booking where the requested service falls outside our scope, appropriate information has not been provided or we reasonably consider that proceeding may be unsafe or unsuitable.

5. Prices and payment All prices are displayed in Australian dollars unless otherwise stated. Where GST applies, it will be included in the displayed price unless clearly stated otherwise. The deposit, full-payment requirement or payment schedule for each service will be shown before booking. Payment may be processed through third-party payment providers such as Stripe, which may have their own terms and privacy practices. You authorise TerraMatrix and its payment provider to process the amount displayed and agreed to at checkout. Where a payment plan or recurring subscription is offered, the amount, frequency and cancellation arrangements will be disclosed before you subscribe.

6. Individual appointments and cancellations For individual bodywork, private ceremonies and similar appointments: You may cancel or request to reschedule by contacting TerraMatrix. At least 48 hours’ notice should be provided wherever possible. Rescheduling is subject to availability. A cancellation made with less than 48 hours’ notice may incur a cancellation fee, limited to the reasonable loss and costs caused by the cancellation. If the appointment is filled by another person, any cancellation fee may be reduced accordingly. A no-show may result in the amount paid being retained or the outstanding appointment price being charged where this reasonably reflects the loss caused by the missed booking. Illness, family emergencies and exceptional circumstances will be considered reasonably and individually. Please contact TerraMatrix as early as possible. Nothing in this section limits any rights you may have under the Australian Consumer Law.

7. Workshops, ceremonies, retreats and gatherings Workshops, group ceremonies, retreats and gatherings may involve advance venue, accommodation, catering, facilitator, transport or supplier costs. Any event-specific deposit, payment schedule, transfer and cancellation conditions will be provided before booking. Those specific conditions form part of these Terms. Where event-specific conditions conflict with these general Terms, the event-specific conditions apply to that booking, subject always to the Australian Consumer Law. Unless the event information states otherwise: bookings may be transferred to another eligible person with TerraMatrix’s prior written approval requested changes are subject to availability and reasonable administrative requirements payments may be retained only to the extent reasonably necessary to cover services already supplied, committed third-party costs and losses arising from the cancellation TerraMatrix will take reasonable steps to reduce losses, including attempting to refill a cancelled place where practical. Participants are responsible for arranging and checking their own flights, passports, visas, insurance and travel arrangements unless these are expressly included in the booking. Travel insurance is strongly recommended for retreats and destination events.

8. Cancellation or changes by TerraMatrix TerraMatrix may need to change a facilitator, schedule, activity, venue or other detail where reasonably necessary. We will notify affected participants as soon as practical. If a material change means the agreed service can no longer reasonably be provided, you may choose not to proceed and will receive an appropriate refund for the undelivered portion of the service. If TerraMatrix cancels an experience and does not provide an acceptable alternative, amounts paid for the cancelled service will be refunded. To the extent permitted by law, TerraMatrix is not responsible for separate travel, accommodation or other expenses arranged independently by a participant. Nothing in this clause excludes rights that cannot lawfully be excluded.

9. Health, safety and relevant information You must provide accurate information about matters that may reasonably affect safe participation, including relevant: injuries, pain, health conditions or mobility requirements allergies or intolerances pregnancy or recent birth medications mental-health or support needs accessibility requirements recent surgery or medical treatment. You must tell TerraMatrix if relevant information changes before the service begins. Providing health information does not guarantee that a service will be suitable. Where uncertain, you should obtain advice from an appropriately qualified healthcare professional. You may pause or withdraw consent from any activity or form of touch at any time. Please communicate discomfort, pain, concern or a change of mind immediately. TerraMatrix may adapt, postpone or stop a service where continuing would be unsafe, inappropriate or outside professional scope.

10. Cacao, food and beverages Participation in cacao or other food and beverage elements is optional. You must disclose relevant allergies, intolerances, medications, pregnancy or health concerns before consuming anything supplied during an experience. Ingredients will be explained where reasonably practical, but TerraMatrix cannot guarantee that every venue or preparation environment is entirely free from traces of allergens. Where you are uncertain about suitability, obtain appropriate medical advice and choose not to consume the item until you are satisfied it is safe for you. TerraMatrix may refuse or postpone participation where a person appears intoxicated or otherwise unable to participate safely.

11. Children and young people Bookings involving children or young people must be made or approved by a parent or legal guardian. A parent or guardian must provide relevant health, accessibility, emergency and consent information and remain available or present where required for that experience. TerraMatrix respects the developing autonomy, boundaries and assent of children and young people. Parent or guardian permission does not remove the participant’s right to decline touch or withdraw from an activity. Parents and guardians remain responsible for appropriate supervision except where TerraMatrix has expressly agreed otherwise in writing.

12. Participant conduct Participants must behave respectfully towards facilitators, practitioners, venue staff and other participants. Harassment, discrimination, intimidation, violence, unsafe conduct, deliberate disruption or serious disregard of another person’s boundaries will not be accepted. TerraMatrix may ask a participant to leave or discontinue an experience where reasonably necessary to protect safety, wellbeing or the integrity of the group. Any refund in these circumstances will be determined reasonably according to the circumstances, services already provided, losses incurred and applicable consumer law. Participants may not photograph, film or record another person without that person’s clear consent.

13. Photographs, recordings and testimonials TerraMatrix will not use an identifiable photograph, recording or testimonial for public marketing without appropriate permission. Where permission is requested, you may decline without affecting your access to services. Any permission will be handled separately from general participation consent and in accordance with the Privacy Policy.

14. Australian Consumer Law Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified. Where a service has a major failure, consumers may be entitled to cancel the service and receive a refund for the unused portion or compensation for its reduced value. Where a problem is not major, TerraMatrix must be given a reasonable opportunity to rectify it. These rights apply in addition to any cancellation, rescheduling or goodwill policy offered by TerraMatrix.

15. Liability and personal responsibility TerraMatrix will provide its services with due care and skill. You remain responsible for: deciding whether to participate communicating your needs and boundaries following reasonable safety instructions seeking professional medical or psychological advice where required avoiding activities that you reasonably believe are unsuitable for you. To the maximum extent permitted by law, TerraMatrix is not liable for loss caused by: information you failed to disclose your failure to follow reasonable instructions actions outside TerraMatrix’s reasonable control independent services supplied directly to you by a third party. This clause does not exclude liability for negligence, breach of consumer guarantees or any other liability that cannot legally be excluded.

16. Third-party providers and links Some experiences may involve independent venues, accommodation providers, facilitators, caterers, transport operators, booking systems or payment processors. Where you contract directly with a third party, that provider’s terms and policies may also apply. TerraMatrix remains responsible for the services it directly supplies to the extent required by law but is not responsible for the independent acts or omissions of a third-party provider where TerraMatrix does not control that provider. External website links are provided for convenience. TerraMatrix does not control the content, availability or privacy practices of external websites.

17. Gift vouchers Keep this section only if you offer gift vouchers. Purchased TerraMatrix gift vouchers will be valid for one (1) year from the date of purchase unless a lawful exception applies. Gift vouchers: must be presented or identified when booking are subject to service availability cannot generally be exchanged for cash except where required by law may be used only for eligible TerraMatrix services. Any additional voucher conditions will be clearly disclosed before purchase. Australian gift cards generally need a minimum three-year expiry period.

18. Intellectual property The TerraMatrix name, website content, written materials, graphics, workshop materials, meditations, course content and other original resources are owned by or licensed to TerraMatrix. You may access them for personal, non-commercial use connected with your TerraMatrix experience. You must not reproduce, sell, publish, distribute, teach from, record or commercially exploit TerraMatrix materials without prior written permission.

19. Website information TerraMatrix takes reasonable care when preparing website information, but information may occasionally be incomplete or require updating. Website information is general and does not constitute individual medical, psychological, financial or legal advice. The details shown in your booking confirmation and any specific written event agreement take priority over general promotional wording.

20. Privacy and communications Personal and health information is handled in accordance with the TerraMatrix Privacy Policy. By making a booking or enquiry, you agree to receive essential communications concerning that booking or enquiry. Marketing communications will only be sent where you have opted in or where otherwise permitted by law. You may unsubscribe from marketing emails at any time.

21. Concerns and disputes Please contact TerraMatrix promptly if you have a concern about a service, payment or booking. Changes to these Terms TerraMatrix may update these Terms to reflect changes in services, systems or legal obligations. Updated Terms will apply to future website use and bookings from the date they are published. A booking already confirmed will generally remain governed by the terms accepted at the time of booking unless a change is required by law or agreed with you.

23. Governing law These Terms are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia. The parties submit to the courts and tribunals with jurisdiction in Western Australia, subject to any rights that cannot lawfully be limited.

24. Severability If any part of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible.
